Terms of Use for SmartDrive and Petrocard:

Your use of the SmartDrive/Petrocard indicates your agreement to all the terms and conditions mentioned hereunder including the preamble (hereinafter referred to as “The Terms of Use”), so please read the terms of use carefully before proceeding. By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by SmartDrive/Petrocard Policies (including but not limited to Privacy Policy). 

BPCL has the right to unilaterally amend the Terms of Use at any time by posting an updated version. The updated version of the Terms of Use shall take effect immediately upon posting. It is your responsibility to review these Terms of Use periodically for updates / amendments. Your continued use of SmartDrive/Petrocard following the posting of amendments shall mean that You accept and agree to the amendments including additional terms or removal of portions of these terms, modifications etc. As long as You comply with these Terms of Use, BPCL grant You a personal, non-exclusive, non-transferable, limited privilege to enter and avail the Services.

"SmartDrive” Wallet is a Closed Pre-paid Payment Instrument (mobile app based for Android and iOS) . You can use Debit Card, Credit Card , Net Banking , UPI etc to recharge the   wallet thru Payment gateway. If you do not wish to use wallet balance to make a purchase, you can use Payment Gateway or Direct Pay Option to make payment for goods/services Purchased from BPCL merchant network.

"Petrocard” Wallet is a Closed Pre-paid Payment Instrument (Physical card) . You can use Debit Card, Credit Card , Net Banking , UPI etc to recharge the  wallet thru Payment gateway. If you do not wish to use wallet balance to make a purchase, you can use Payment Gateway or Direct Pay Option to make payment for goods/services Purchased from BPCL merchant network.

Products:

The SmartDrive and Petrocard shall be used to purchase Petro, Speed, Speed 97, Diesel, Hi Speed Diesel,CNG, ALP,LNG, In&Out store items,Lubes and Adblue etc. if available and enabled by BPCL.

Registration:

In order to use the full spectrum of the Services, You need to register on the HelloBpcl App and provide us with accurate and complete information as requested. You are also required to keep your accounts and contact information complete and updated at all times. Any account found to contain incorrect and/or outdated information will be liable to be suspended and the decision of BPCL in this regard shall be final.

KYC:

For initial activation of your Wallet, the user ID and password shall be sent to the User’s mobile number via SMS.

You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the requirements of SmartDrive/Petroacard as intimated from time to time, SmartDrive shall have the right to indefinitely suspend, terminate or block access to Your Wallet and the decision of BPCL in this regard shall be final. 

The Recharge limit per month is Rs.20,000/- (twenty Thousand)

Refund:

In case of  dispute , you will write to us at   petrobonus@bharatpetroleum.in.  The refund shall be processed as per policy and time lines applicable. 

Once your Refund Request  is received, we will get back to you with further update.

If approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 7 business days.

Closure of Wallet:

Existing users do not have option to withdraw money and close the wallet.

BPCL RIGHTS:

  1. The customer agrees that BPCL may offer or withdraw the payment gateway facility of any entity at any time.
  2. BPCL can offer or withdraw this payment gateway facility through any channel like website / mobile application.
  3. BPCL can provide access or restrict any customer for online recharge facility at their discretion.
  4. BPCL shall provide credit to the customer on best effort basis upon authorization from bank.
  5. BPCL shall complete/ execute all orders as expeditiously as possible and without any delay. In case, the Bank does not settle payment with BPCL, BPCL reserves the right to suspend customer account immediately and also proceed for recovering the unsettled amount from customer.

CHARGEBACK / REFUND / CANCELLATION POLICY:

  1. Customer agrees that once the transaction is completed successfully at BPCL’s end, BPCL shall not be under any obligation to refund the amount debited from the customer’s account.
  2. Customer also agrees that once the transaction is completed successfully at BPCL’s end he shall not make any request for cancellation or chargeback in respect of the said transaction.

DISCLAIMER:

  1. BPCL shall not be responsible for any actions, proceedings, claims, liabilities (including statutory liability), penalties, demands and costs, awards, damages, losses and/or expenses, legal fees, charges brought against the customer either directly or indirectly as a result of his/her transaction(s) through the payment gateway.

INDEMNITY :

  1. The customer making transaction at BPCL’s website undertakes and agrees to indemnify at all times and hold BPCL from and against all actions, proceedings, claims, liabilities (including statutory liability), penalties, demands and costs, awards, damages, losses and/or expenses, legal fees, charges however arising directly or indirectly as a result of his/her transaction through the payment gateway.

DISCLOSURE OF INFORMATION:

  1. BPCL may disclose the Sensitive Information, if it needs to be disclosed pursuant to any order/direction of a Court and/or regulatory authority of competent jurisdiction, to the extent specified in the order/direction of such Court and/or regulatory authority. Subject to this clause, the BPCL, at all times, shall protect and keep confidential all information related to customer’s transaction through the BPCL’s website (“Sensitive Information”).

TRANSACTION LIMITS :

  1. BPCL reserves the right to impose limits on the number and value of recharge transactions on any Customer during any time period, and reserves the right to refuse to complete transactions exceeding such limit without any prior notice and information to Customer.

FEES AND OTHER CHARGES :

  1. In consideration of the services provided by Payment Gateway, Payment Gateway shall collect TDR / MDR/ Convenience Fee along with applicable taxes from the Customer at the time of transaction. These charges are directly paid by the Customer to the Payment Gateway without any financial / legal obligation to BPCL.

NO CONSEQUENTIAL DAMAGES:

BPCL shall not be liable to Customer for any loss or damage whatsoever or howsoever caused arising directly or indirectly in connection with the BPCL’s Website, including without limitation any: ‐

  1. Loss of data which is lost during transmission;
  2. Any consequential loss or damage or loss of profit, business, revenue, goodwill or anticipated savings arising out transaction initiated by the customer.

CLAIMS AND DISPUTES ON TRANSACTIONS :

  1. In case, the Issuing Bank raises a claim on Payment Gateway or BPCL in respect of any Transaction at any stage, after receiving information from Payment Gateway, BPCL shall support Payment Gateway in recovering the amount from the Customer.

    Without prejudice to the aforesaid provisions, the following transactions shall be deemed to be covered above:

    • Any payments involving the alleged forgery of the Customer’s Card Number and PIN, or that of the Card Number, Card Expiry date, Customer Name, Transaction amount, etc. of whatsoever nature.
    • Any charge/debit, which is a suspect charge, until proved otherwise.
    • Any charge/debit made on a card other than a Valid Card.
    • Any charge / debit arising out of any alleged hacking, breach of security or encryption (if any).
  2. In such cases, BPCL shall have complete rights to suspend the Customer’s account and adjust funds and /or loyalty points available and also initiate all actions deemed fit to recover funds from the Customer.
  3. BPCL shall be entitled to suspend all payment and services and customer’s account if any fraudulent practices are noticed.
  4. Customer is responsible for any action at his end; anybody using his credential, BPCL shall not be responsible for the actions.
  5. In the performance of the Services, BPCL shall be entitled to assume that messages/requests originated from the Customer are deemed to be authorized by the Customer and BPCL shall not be liable for any losses or damages caused to any person whatsoever as a result of any such message being unauthorized, inaccurate or fraudulent.

CUSTOMER SUPPORT:

  1. BPCL shall provide a commercially reasonable level of customer support to Customers. Such support shall include appropriate notice to Customers of
    (i) a means of contacting BPCL in the event the Customer has questions regarding the nature of services and
    (ii) procedures for resolving disputes. Disputes if any must be addressed to BPCL’s Helpdesk; the details are available in the Program’s website.
